Czech Drug Laws

    just wonderin how lenient the authorities are on cannabis use, im only an occasional smoker, however i dont want to be banged away for ten years at the cost of chillin with a blunt and a beer on my hotel balcony

    I believe, that possession of small amount of marijuana is permited by Czech law for persons older 18 years.

    Where are you living? No amount is permited by the Czech law. A small amount only results in a light penalty (fine).

    Shaka: Well, I'm not smoker, so I may be wrong.

    I thought, that possession of small amount isn't crime, only misdemeanour.

    I think no amount is permitted as well as smoking it. But there's big diference between what says law and what you can you (what people do).
    I'm sure you'll be okay as a occasional smoker, you can smoke it outside and you shouldn't have problems. I wouldn't suggest smoking it in a restaurant, because the bartender/owner could call police, but it really depends on the restaurant. In some restaurants you can smoke weed without any problems. For example I've been in a pub and even the owner smoked weed there and he even offered me to smoke with him. It really depends.

    Consumption is legal unless in combination with some other activity, e.g. driving.

    Production, distribution, import and export are illegal.

    Holding of small amount is legal. Holding of bigger amount is illegal and automatically results in indictment on production and distribution.

    There is no legal specification of small amount. According to internal direction of police presidium it is under 20 joints with 1.5 % delta 9 THC. According to internal direction of state prosecutor's office it is under 0.3 g of THC (= cca 10 joints).

    :shock: if you can smoke it in some restaurants, tthen they not as harsh about it as i thought :D
    wouldnt smoke it in places like that anyway, and it wouldnt be much-as long as i dont get hung, drawn and quartered for it!

    Wer is right essentially, but the police internal directions are not the law. It always depends on the judge's opinion.

    Remember: Where is no accuser there is no judge.

    My (very simplified!) translation of excerpts from drug law
    ( http://knihovna.adam.cz/drogy99/legis.htm#98 )

    - drug production, import/export, distribution, selling etc... 1 - 5 years prison sentence
    - same, but as member of organized group 2 - 10 years prison sentence
    - same, but if children are involved 8 - 12 years prison sentence
    - big drug operation 10 - 15 years prison sentence

    Illegal production, distribution, import, export or intermediation ... confinement for 1-5 years.

    in big extent, in organized group or towards underage (under 18 ) ... 2-10 years.

    with considerable benefit, towards person under 15 or to the detriment of somebodys health ... 8-12 years

    to the severe detriment of health of more people, in the event of somebody's death, with benefit of extensive extent or in organized group functioning in more states ... 10-15 years

    Generally not a problem. Posession of a small amount is a misdemeanor rather than actually legal. However I've sat in pubs and smoked on many occasions, you just want to be a bit sensible about where and when. It's generally much more lax than then UK, and certainly than the US.
